MY EXPERIENCE TRYING TO DO BUSINESS
WITH CASEY
MCBROOM OF SHIELD LABS
I’ve
been a comics fan since I was a wee lad, building collections and then losing
them, taking a long breather from time to time. I built my last collection from
1980 (when I was wowed by issue 136 of Uncanny X-Men) through 2015 (the Secret
Wars mini-series). By then I had about 11,000 issues.
Secret
Wars seemed like a good exit point from collecting comics. Marvel was resetting
its continuity … and my Parkinson’s symptoms were gathering strength. I saw the
writing on the wall, and that writing was shaky. I realized that 80 short boxes
of comics would constitute a burden on my caretakers or heirs – or an asset if the
collection were sold by someone with some idea of its worth.
I sold many
of my back issues as sets on ebay.fr from 2018 through 2021. But as my stamina
waned, it became too difficult to list and ship the comics, so I sold what
remained to a friend who runs a Parisian comic shop. For the first time in 40
years, comics I had none.
Still, I
wanted something to serve as a memorial to the hobby I had enjoyed for so long.
I decided to use some of the proceeds from my sales proceeds to buy a replica
of Captain America’s shield – not a plastic toy, but a hand-crafted metal
object that would look good hanging on my wall.
After
doing a little research, I placed an order with Shield Labs in Independence,
Missouri. Which turned out to be a mistake, one that cost me not only money but
also time. And since my remaining time on this earth is alarmingly finite, I resent
wasting so much of it on this misadventure.
I know
almost nothing about Casey McBroom, who does business as Shield Labs. I know he
has a good-looking website where he sells about 30 different movie prop
replicas. I know that during the pandemic he took advantage of the federal
government’s Paycheck Protection Program, borrowing about $29,000 for “payroll”
and having the loans forgiven in 2021 and 2022. I assume, from the way he wishes
correspondents a “blessed day,” that he considers himself a godly sort of
person. And from my own experience, I know he can be a weasel.
I ordered a replica shield from him in April
2021, paying nearly $800. I never received the item. It took until July 2023 to
get back most (but not all) of my money. I ended up writing him 33 emails over
a period of 27 months -- 25 of which he ignored. He and his wife promised on five
separate occasions to resolve my complaint, and finally coughed up some money
only after he was threatened with exposure on Instagram as a scammer.
What
follows is my full correspondence with him, presented verbatim. I have added some brief notes in [brackets] to
provide context or highlight some particularly egregious examples of his
double-talk. Is Casey McBroom and his nonsense worth 5,000 words? Certainly
not. But his conduct in this matter is so shameless that it may amuse you, and this
chronology may serve as a warning to anyone else choosing to do business with
him.

Also, I got an email from a polly a bit ago that I see now
is Not you? I assumed it was, but I am guessing they must be associated with
you as the email seemed to mirror your previous one. It had a link to a
defamatory thread you made about me? I have been as helpful as I can be with
the information I had. I’ve been polite and I’m committed to helping you till
the end, regardless of the thread you want to make about me, but if your order
was shipped out and there was a postal issue there is nothing I can do about
that happening. The domestic and international post offices have been
Historically Bad the last too years handling mail and covid had effect a-lot of
that state to state and country to country. I hope you can understand that.
Anyway, that said. I will go ahead and state here in case I
did not before. I’ll confirm whether your order shows it was delivered or not,
and if not of course I am happy to re-make/reship your order at my expense, or
even issue a refund and lose the shipping and materials if that ends up being
preferable. I understand where you may be at viewing the order and issues, and
I trust if you say it was not received then it was not, and I will verify that.
Regardless I appreciate your initial support and interest in my artwork and

[This email of his is just filled with shameless
gaslighting. Casey seems to represent that I have been providing him with bum
information all along when in fact I got my order number wrong once and I
corrected the error within hours. And he seems to have forgotten that he
promised in May to deal with this problem “as soon as possible.” He says he is
“happy to help,” but this is only the start of his yearslong campaign to avoid resolving
an issue in which he is clearly 100 percent in the wrong, both legally and
ethically. I am also left cross-eyed by his assertion that “I trust if you say
it was not received then it was not, and I will verify that.”
[The “defamatory thread” he refers to was posted on therpf.com,
which I guess is popular among cosplayers. I didn’t know about the site until
my lawyer brought it to my attention. To this day I’ve had no contact with the
two individuals who posted.

Hi Mark,
We found
this message and one other it seems we missed in our Spam folder, sorry to hear
you are still having issues? We definitely recall your order, I believe we had
multiple shipping addresses, and attempted to ship to Florida and then to
France, and have already spent a couple of hundred in shipping. Our last email
received was in the September, and we assumed the order finally made it to you
without issue this time.
I can
and will check on this for you As Soon as the Post opens. I can only access what
it says on shopify but maybe there was incorrect tracking input, but I will
check the shipping account. I know on our last attempt to reship we confirmed
the address on hand for France. Either way if it shows it isn’t delivered, and
is Non deliverable for some reason I’ll work with you to issue some form of
refund and just eat the cost of materials and shipping. After 6 months we don’t
have access to even manually issue a refund through Paypal so if we end up
having to issue one it will have to be just by sending the funds directly to
you and the order will be archived. We’ve moved this to our main inbox and
flagged it with priority, and will check back in Monday as soon as I have
access. Sorry for the ongoing issue, we have had some orders to Australia and
Mexico for some reason have been non deliverable and just had to cancel the
orders as well. Thank you again for your patience and support.

[Casey’s
wife continues the gaslighting campaign. My latest email “and one other” ended
up in the spam folder – the modern equivalent of “the dog ate my homework” –
but I sent four. “We had multiple shipping addresses,” which makes it sound
like I couldn’t make up my mind. In fact, I provided one alternate address, in
Florida, in November and December 2021, in emails the McBrooms never bothered
to acknowledge.
[Note
that I received no shipping notifications for any of these heroic efforts to send
the shield to various addresses, and Misti makes no attempt to explain the
tracking information on the USPS website: seven months before, the McBrooms
registered a package with the USPS but never brought it to a post office. In
fact, there is no evidence that they made any attempt to fulfill my order:
no shipping notifications other than the one in October 2022, no tracking
numbers, no explanation for how multiple shipments to Florida and France could
go astray.
[Finally,
I was unsettled by the reference to “some kind of refund” and the noble
sacrifice to “just eat the cost of materials and shipping.” Yes, Misti, that’s
what you do when someone pays for a product and you don’t deliver. And for
those keeping track, this is the fourth time in two years the McBrooms have
vowed to resolve this issue quickly.]

bounced around for a couple days. Then the USPS sent it back to Casey!]

We got
the shield back from USPS and sent it back out with the same label, it got
bounced right back this past week from Customs. I’m not sure what the issue is.
We have had historic issues with the US Post the past couple years. It’s
costing over $100 each time to ship. This time the shield came back pretty
banged up from customs! I can’t reasonably ship this one damaged. I can either
make & ship Another at my expense, or at this point with it being just
unable to be delivered and the original order is back here now, I can cancel
and issue a refund of sorts, and I will just take the loss on shipping and
materials, and try to salvage this shield. If you’d rather a refund, because
the refund window on Paypal is closed for issuing a refund, I can Paypal you
the original order value directly. Just send me your current paypal email
address, pr if you have venmo I can venmo you the amount. With Venmo I believe
there would be no fees for you. Let me know which solution works best for you.

acknowledge receipt of your payment of 565.91 euros on 12 July 2023. But you
know full well that this amount (the equivalent of $630) is only a PARTIAL
refund of what I paid you in April 2021: $650 for “24 inch classic replica
shield prop” plus $123.98 for shipping, for a total of $773.98.
You
still owe me $143.98.
I
suspect you are trying to beat me out of the shipping – although I have no idea
what your justification for this could be. I have been telling you since August
2022 that I no longer wanted the shield, I just wanted my money back. You
ignored my request and tried to ship it anyway. And the Federal Trade
Commission requires that businesses ship items ordered on the Internet within
30 days (not 730 days), or make a FULL refund.

course, I haven’t heard from him.
If this
account shows Casey McBroom to be a weasel, it also shows me to be wholly
unprepared to deal with such miscreants. But I’ve always been at a loss when
confronted by someone who is acting unethically, illegally, immorally. Casey
should have answered my first email, and resolved the issue immediately. The
situation is completely unambiguous: shield paid for, shield not received,
replacement or refund to be issued immediately. But he didn’t do that.
Instead,
he ignored 25 emails of 33 sent. He and his wife promised six times to resolve
the issue expeditiously, then did nothing. Finally, 819 days after I placed my
order and hours after my girlfriend threatened to badmouth him to her nearly
300,000 Instagram followers, he coughed up a refund. And even then, he shorted
me by $144. That’ll teach me! (Teach me what, exactly?)
My only
regret in all this (aside from the obvious one, that I sent this idiot my money
in the first place) is that I threatened to sue him and then didn’t follow
through. But a lawsuit would have cost thousands of dollars, and the outcomes
would be uncertain. Also, it would have required strength I didn’t have. In
addition to my Parkinson’s symptoms, since April 2021 I have been hospitalized
twice for unrelated illnesses, and visited the emergency room perhaps half a
dozen times. I need my rest.
But this
clown still owes me $143.98. The fight continues.
I can do
this all day.
